najem okazjonalny, meldunek, residence card — what they are, what you'll be asked to sign and what not to fear. Especially if you rent as a foreigner.

Three types of rental contract

The contract type affects the paperwork at signing and the deposit size — ask upfront.

  • Zwykły najem (standard) — maximum tenant protection, hard to terminate. Usually your case.
  • Najem okazjonalny (occasional) — for private (individual) landlords; easier to evict, so it needs a notarial annex. Deposit up to 6 months' rent.
  • Najem instytucjonalny — when a company or rental operator lets the flat.
Najem okazjonalny: what it is and why they ask

It's a normal lease plus a notarial annex that makes evicting a non-payer easier. For an honest tenant it adds no risk — agreeing is fine.

  1. A notarial declaration of voluntary submission to enforcement (oświadczenie o poddaniu się egzekucji), signed at a notary.
  2. Naming another address where you could live if evicted (an alternative address).
  3. The consent of that address's owner to host you there.
⚠️ The notary is paid (usually about 1/10 of the minimum wage + VAT) — agree who pays. The alternative address is the most common snag for foreigners: a friend's or relative's address with their written consent works.
Meldunek: registering at an address

Meldunek (zameldowanie) is residence registration. Free, done at the city/gmina office, available for temporary stay.

  • You need a document proving your right to the flat (the lease), or the owner's confirmation on the form.
  • The owner doesn't «register you into their home» in the old sense and loses no rights to the flat — it's just a record of residence.
  • Meldunek is often needed for the residence card, a bank, school, doctor, PESEL.
⚠️ With a lease, registering is your right. The «landlord is against meldunek» fear is usually a myth.
Documents for the residence card & legalisation
  • For a residence card (karta pobytu) you're usually asked to prove your place of stay: the lease or a statement providing accommodation.
  • Keep the signed lease and, if possible, meldunek — together they cover several procedures at once.
  • A Polish-language contract is normal. Ask for a copy early and translate the key clauses (the listing's «AI breakdown» button helps).
What the contract should contain
  • Parties, flat address, term (fixed/open-ended) and the notice period (okres wypowiedzenia).
  • Rent (czynsz najmu) + building fee (czynsz administracyjny) + how utilities are paid.
  • Deposit amount and refund terms; a handover protocol (protokół zdawczo-odbiorczy) as an annex.
  • Who covers minor repairs; pet rules; number of occupants.
  • Penalties and early-termination terms.
Red flags and what NOT to fear
  • 🚩 They demand a prepayment or deposit before viewing and signing — stop, a classic scam.
  • 🚩 No written contract, «all on trust» — no deposit protection and no right to meldunek.
  • 🚩 The owner is against any meldunek or protocol — a reason to be cautious.
  • ✅ najem okazjonalny and a notary — a lawful practice, not a scam.
  • ✅ A request for documents or income — a normal check, not an insult.

jestem zainteresowany/a najmem tego mieszkania. Zanim umówimy się na oglądanie, chciałbym/chciałabym dopytać:

1. Jaki rodzaj umowy Państwo proponują — zwykły najem czy najem okazjonalny?
2. Jaka jest wysokość kaucji oraz czynszu administracyjnego (do wspólnoty/spółdzielni)?
3. Czy media (prąd, gaz, woda, internet) są wliczone, czy płatne osobno?
4. Czy przy przekazaniu mieszkania będzie protokół zdawczo-odbiorczy?
5. Czy mogę się zameldować pod tym adresem — potrzebne do karty pobytu i spraw urzędowych?
